Privacy Policy

ON-CALL POLICY (BC)

Intent

The West Egg Group Corp. has adopted this policy to ensure that necessary staffing requirements are met to ensure operational needs. To meet these operational needs, some employees may be required to work on an on-call basis. This policy shall outline the on-call status of an employee as per the Employment Standards Act of British Columbia.

Guidelines

The West Egg Group Corp. shall require some employees to work on an on-call basis from time to time. Should The West Egg Group Corp. require the employee to remain at a specific location (other than that of the employee’s residence), the employee shall be paid wages as they are under the direction of The West Egg Group Corp. and are considered to be working. If The West Egg Group Corp. requires the employee to remain in his/her residence to await a call to work, the employee is considered to be on-call but not considered to be at work and as such, does not require compensation.

Should The West Egg Group Corp. place restrictions on the activities of the employee who is on-call which have the same effect as specifying the location of the employee, the employee shall be considered to be at work and shall be compensated accordingly. 

For example:

An employee whose employer expects a response within an hour of being contacted is not considered to be at work, however, one who must report to the workplace within five minutes of being contacted is, since the employee would have to be within blocks of the workplace in order to meet this expectation.

When an employee who is on-call responds to a request to report that is made by The West Egg Group Corp., the employee has now “reported” to work and, as such, is entitled to the minimum daily pay under section 34 of the Employment Standards Act starting from this time.

Safety

  • Employees who are in on-call status must remain ready for work while away from work and on-call.
  • Any on-call employee who cannot report to work safely as required must report their inability to do so to management immediately. Any failure to report to work while on-call must be accompanied by appropriate documentation. In the event that the failure to report is deemed unnecessary and avoidable, the employee may be subject to disciplinary action.
